Dividing your property fairly after separation
When a married or de facto couple separates, there’s a legal process for dividing the assets of the relationship. This is called a property settlement, and it decides what each of you takes away.
A property settlement can be reached by agreement, or by a court order if agreement isn’t possible. The law much prefers agreement, but a court order is binding and final. Ignoring a court order is contempt of court, which can lead to a heavy fine or, in serious cases, jail.
We’re known for fair resolutions, and we’ll work to settle your property in a way that lets you move on with your life.

Ways to Settle Your Property
By agreement
If you and your former partner can agree on how to divide your property, the settlement can be made by consent. This is the outcome the law prefers.
With a binding financial agreement
If you agree on how your property should be divided, you can make a binding financial agreement under the Family Law Act 1975. You each need independent advice from a lawyer, who explains what you’re signing and its legal effect.
By court order
If you can’t agree, the court can decide how your property is divided. A court order is binding and final, so it’s treated as a last resort.

Whether you’re negotiating an agreement or going to court, we’ll guide you through the process and work towards a fair result.
